Virginia Beach Sees Two Fatal Accidents in One Day

By John Cooper, Virginia Beach Wrongful Death Lawyer

Two shocking accidents that led to a loss of life rocked Virginia Beach on Monday. One the same day, a pedestrian was killed just over the city border in Norfolk.

With two fatal accidents occurring only hours apart, Monday was a dangerous day to be out on the roads.  All of us at Cooper Hurley Injury Lawyers are saddened after hearing about these two terrible accidents.

Several local news reports state that around 2:30pm a small Nissan Sentra broke down and came to a stop in one of the travel lanes of Interstate 264, just after the Rosemont Road exit.  An oncoming Chevrolet Silverado 2500 work truck rear-ended the broken down Nissan, causing it to spin into an out of service Hampton Roads Transit Bus.  The Nissan burst into flames.

Navy corpsman Tom Gentry stopped at the scene of the crash.  Gentry promptly pulled the unconscious driver, a 31-year-old woman, out of the vehicle as the fire began to spread, the Virginian-Pilot reported.  The other passengers in the car included a 28-year-old man, a 2-year-old girl, and a 5-month-old infant.  Unfortunately, rescuers were not able to save the infant due to the rapidly-spreading fire

Later on May 16th, the driver of a Ford F-150 Raptor pickup truck collided with a Lexus sedan that was coming to a stop for a red light at the intersection of Northampton Boulevard and Pleasure House Road in Virginia Beach.  The driver of the Lexus was pronounced dead at the scene, and the passenger sustained injuries.  The driver of the pickup truck has been charged with reckless driving.

On the same day, WAVY.com reported that a 65-year-old man had died of injuries he sustained after being hit by a pickup truck near Curlew Drive and Newtown Road on Monday morning.

He was identified as Vernon Calvin Hall Jr., 65. Although his condition was originally reported as being stable, he later succumbed to his injuries.

A day later 17 people, including 15 children, were injured when a Norfolk school bus crashed on Indian River Road in Virginia Beach. We were relieved to read all of the injuries were described as minor and the students were released from the hospital on the same day, WAVY.com reported.

The lawyers and staff of Cooper Hurley Injury Lawyers are deeply saddened by these two tragic accidents.  We extend our deepest sympathies to the families of those involved.

As public schools start to let out in June, Virginia Beach will see a sharp increase in the amount of motorists on its roads.  Drivers must exercise extra caution during the summer months to avoid accidents.

Passenger, 18, Dies in Accident at Princess Anne Road and Kempsville Road

By John Cooper, Virginia Beach Car Accident Attorney

Passengers are often victims in car accidents due to no fault of their own. I was saddened to read about the death of an 18-year-old passenger who was killed this week when the car she was riding in hit a flatbed truck.

The Virginian-Pilot reported that she was in the back seat of a sedan when the car collided with a AAA flatbed truck at Princess Anne and Kempsville roads. The crash shut down the intersection for hours.

anne-accident

The Pilot report stated that paramedics took the driver of the car and another passenger to a local hospital. One had life-threatening injuries and the other had serious injuries. The driver of the truck was not hurt in the accident.

My thoughts are with the family of this young lady who lost her life in such tragic circumstances.

More passengers than drivers lose their lives every year in the United States.  In 2011, for example, 877 of the 1,223 fatalities that occurred on the roads were of passengers. Generally speaking, passengers have greater rights than drivers to seek compensation if they are injured in accidents.

A passenger who gets hurt in a car accident usually has an easier case than a driver or any other type of personal injury plaintiff. This is because the passenger does not have to worry about proving liability; one of the drivers is almost always going to be liable.

As with any personal injury claim, in a car accident case the plaintiff must be able to prove liability and damages – how badly the plaintiff was injured.

If the accident was a two car accident, one of the drivers is definitely going to be liable. It is almost impossible to have a two car accident without at least one of the drivers being deemed negligent in some way.

If there is a two car accident, a passenger injury claim proceeds just like any other type of car accident claim, except that the passenger would make the claim against both drivers if they shared liability.

If a loved one has lost his or her life as a passenger in a car accident, you may have grounds to sue the driver’s insurance policy. Call Cooper Hurley Injury Lawyers at 757.455.0077 for a free consultation.

Thousands of Women Sue Merck Over Complications from Birth Control Device NuvaRing

By John Cooper, Virginia Beach Products Liability Lawyer

You may never have heard of the contraceptive NuvaRing. All too often when I hear about it, it’s for all of the wrong reasons and involves injury and illness to women.

I have been seeing a number of product liability cases in which clients have been hurt by medication or devices which were meant to improve their health.

NuvaRing

The vaginal ring contraceptive NuvaRing is the latest device to lead to a flood of lawsuits.

When NuvaRing first arrived on the market in 2001, its manufacturer Merck marketed it as a safe and more convenient form of birth control.

The product is a flexible ring that’s inserted into the vagina. It releases hormones that prevent pregnancy.

The product offered women the advantage of not having to remember to take a daily pill to prevent pregnancy.

As with many devices manufactured by drug companies that are looking first and foremost at the bottom line, NuvaRing has a serious downside.

Women started to report extremely serious injury after using this birth control ring including deep vein thrombosis (DVT), pulmonary embolism and strokes.

The U.S. Food and Drug Administration (FDA) looked into the health claims and published a study in 2011 which showed that vaginal ring contraceptives such as NuvaRing may raise the risk of serious blood clots by up to 56 percent when compared to low-dose birth control pills.

As Virginia Beach injury lawyers, we have watched the problems associated with NuvaRing mount at an alarming rate.

More than 1,000 lawsuits related to this product are set to go to trial in the fall of 2013.

Our Virginia Beach, VA personal injury lawyers accept NuvaRing cases. Call us for a free consultation at 757.455.0077.

Three Virginia Beach Children Are Hurt in School Bus Crash in Southampton, VA

By John Cooper, Virginia Beach Injury Lawyer

As a personal injury lawyer in Virginia Beach, I am always alarmed at the number of accidents involving school buses in the Commonwealth.

I was disturbed to read about how a Virginia Beach school bus carrying children to a 4-H camp in Wakefield ran off the road and into a ditch in Southampton County at the end of last month.

school-bus

The Virginian-Pilot reported three children were transported to Sentara Obici hospital in Suffolk for the treatment of non-life threatening injuries.

According to reports there were 37 people on board the bus. The sheriff’s office was called out to the 33000 block of General Mahone Blvd, which is also called U.S. 460.

The Pilot reported the 77-year-old driver told investigators she hit a bump and went off the right side of the road. She was later charged with failure to maintain control.

Teen Passenger Dies in Single Car Accident on Shipps Corner Road in Virginia Beach

By John Cooper, Virginia Beach Injury Lawyer

Charges are reported to be pending in the wake of the death of an 18-year-old passenger on Shipps Corner Road in Virginia Beach.

Our Virginia Beach car accident lawyers noted this fatal single vehicle crash in the 2800 block of Shipps Corner on Tuesday afternoon.

WAVY.com reported the crash involved one vehicle and two victims. A 17-year-old female driver was taken to a local hospital where she was treated for her injuries and released.  Her 18-year-old male passenger from Virginia Beach died.

Jim Hurley of Cooper Hurley talks about teen drivers

Virginia Beach police said the driver of a 1996 Toyota 4Runner SUV was heading eastbound on Shipps Corner Road in wet conditions “when she lost control of the vehicle and left the roadway, hitting several trees.”

Alcohol was not a factor in this crash. Charges are reported to be pending.

Shipps Corner Road was closed from Old Clubhouse Road and London Bridge Road while the crash was being investigated.

My thoughts as a VA Beach injury lawyer are with the family of this young man. Teen drivers are more likely to be involved in accidents due to their inexperience and the number of fatal teen wrecks often spike over the summer months.

If you have lost a loved one due to a mistake by a driver you may have grounds to file a wrongful death lawsuit. Contact our Virginia Beach personal injury lawyers for a fee consultation.

Virginia Beach Car Accident Lawyer Report : Fatal Crash is Reported near London Bridge Road

By John Cooper, Virginia Beach Car Accident Lawyer

A fatal single vehicle crash occurred in Virginia Beach on the afternoon of August 6.

Grazia Moyers of Virginia Beach Police said officers responded to the scene of a vehicle crash at London Bridge Road and Drakesmile Road around 4 p.m, reported WAVY.com

She said there was one vehicle and two victims; one person was pronounced dead. The other person was injured at the scene of the accident that led to the closure of Shipps Corner Road from Old Clubhouse Road and London Bridge Road.

PD: Vehicle crash causes fatality

My thoughts as a Virginia Beach car accident lawyer are with the family of the deceased person. It’s not clear if the person who died in this crash was a driver or a passenger. A passenger will often have grounds for a personal injury lawsuit where a driver is at-fault. In some cases the family of a deceased passenger has grounds to file a wrongful death lawsuit.

If you have been hurt in a single car accident or a family member has been killed you should consider contacting a Virginia Beach injury lawyer who can help you at this traumatic time.

Police Search For Vehicle that Left Two Injured on Indian River Road in Virginia Beach

By John Cooper, Virginia Beach Car Accident Lawyer

A two vehicle accident in Virginia Beach left the occupants of an overturned car with injuries, according to Virginia Beach Police.

Virginia Beach police responded to an accident at the intersection of Indian River Road and Ferrell Parkway at about 7 p.m. on July 19, 2013, where they found an overturned vehicle in the road, the Daily Press reported.

Although the wreck initially appeared to be a single-vehicle accident, witnesses later said a second vehicle had caused the first to overturn.

The two occupants of the overturned vehicle were taken to a local hospital for treatment of injuries.

Police officers found the tag for the vehicle that allegedly was involved in the accident, according to a police press release and investigators are seeking a 2006 gold Chrysler Pacifica, bearing heavy damage to its front and side.

As experienced Virginia Beach car accident injury lawyers, we report on many cases in which hit-and-run drivers flee accident scenes and leave other motorists with injuries.

If you are hurt by a hit-and run driver, and the driver cannot be found, you can make a claim on your own insurance policy for any injuries resulting from the accident.

In Virginia you can make a claim even if the vehicle that caused you to run off the road never actually touched your vehicle as long as a police report was made at the time.  We have successfully handled many of these John Doe unknown motorist cases.
